Terms & Conditions

Welcome to AMH Digital! These Terms & Conditions explain what you can expect from us and what we expect from you when you use our services. By ordering or using our services, you agree to these terms. Please read them carefully.

Quick Summary (Plain English)

  • We provide website design/development and managed hosting services in collaboration with a trusted third-party hosting provider.
  • Hosting infrastructure is not owned by AMH Digital; it is provided by a partner based in the United Kingdom by default and follows UK laws.
  • Hosting in the EU, USA, or other regions can also be arranged based on request and availability.
  • We act as your first line of support and handle management, while the provider's technical staff handle deeper infrastructure issues.
  • You agree to provide required content, pay invoices on time, and use services responsibly.
  • All payments are final and non-refundable once work has commenced.
  • Hosting plans include security measures, backups, and support, but they still have technical limits such as inode limits.
  • You own your content but must ensure it complies with applicable laws.

1. Acceptance of Terms

  • Using any AMH Digital services (hosting, domains, website development, design) means you accept these Terms & Conditions.
  • Quotes are valid for 30 days. Once accepted and invoiced, the contract is binding.

2. Services We Provide

Website Design & Development

  • We create responsive, secure, and optimized websites.
  • Final ownership of code/design is transferred after full payment.

Managed Web Hosting Services

  • Hosting infrastructure is provided by a third-party hosting partner.
  • By default, hosting is based in the United Kingdom and follows UK laws.
  • Hosting within the EU, USA, or other regions can be arranged upon request and availability.
  • AMH Digital does not own or operate the physical servers. We manage your hosting account on your behalf, provide support, and liaise with the provider's technical staff for advanced issues.
  • Hosting includes LiteSpeed technology, automated backups, free SSL, virus and spam protection, and managed updates.

Domain Services

  • AMH Digital is not a domain registrar. We work with trusted third-party registrars to register, renew, and manage domains on behalf of our clients.
  • This means you don't have to handle domain configuration or renewals yourself — we take care of the process and support you directly.
  • By default, domains are registered with our chosen providers who follow international standards (ICANN policies) and applicable local laws.
  • On request, we can configure your domain to use Cloudflare for additional security and performance benefits.
  • While we manage and support your domain setup, the registrar's own terms and technical limits also apply, and certain issues (e.g., registry outages or ICANN policies) are outside of AMH Digital's direct control.
  • You remain responsible for ensuring your chosen domain name does not infringe on any third-party rights or legal restrictions.

3. Hosting Technical Limits (Important)

  • Each hosting plan includes generous SSD storage and unlimited bandwidth.
  • However, cPanel hosting accounts have a technical inode limit of 500,000 inodes per account.
    • An inode is a count of files and folders.
    • Large numbers of small files (e.g., excessive emails, cache files, or unused backups) can reach this limit even if storage space remains.
  • We will notify you if your account approaches this limit so you can clean up unnecessary files or consider an upgrade.
  • Exceeding inode limits may cause performance issues or service restrictions.

4. Your Responsibilities

  • Provide all required content and information promptly.
  • Ensure all content complies with copyright laws and is not unlawful or inappropriate.
  • Maintain your own backups if you make major changes, even though we run automated backups.
  • Keep your contact details updated so renewal notices reach you.
  • Respect our zero-tolerance policy for abusive or threatening behavior.

5. Payments

  • All invoices issued by AMH Digital must be paid in full within 15 days of the invoice date, unless otherwise agreed in writing.
  • Accepted payment methods: We currently accept payments via bank transfer or PayPal. Any transaction fees charged by your bank or payment provider are your responsibility.
  • Currency: All prices are quoted in Mauritian Rupees (MUR) unless otherwise specified.

Late Payments

  • If payment is not received by the due date, AMH Digital reserves the right to:
    • Suspend or limit hosting services (including email and website access).
    • Allow the domain name to lapse, which may result in loss of ownership.
    • Apply a reconnection or reactivation fee to restore suspended services.
  • AMH Digital is not responsible for any loss of data or service availability resulting from non-payment.
  • Failure to pay invoices may result in permanent data loss if the hosting provider deletes unpaid accounts.

Renewals

  • Hosting and domain services are billed on a recurring basis (e.g., annually).
  • It is your responsibility to ensure payment is made before the renewal date to avoid service interruption or domain loss.
  • We will make reasonable efforts to send renewal reminders, but failure to receive a reminder does not remove your obligation to pay.

Refunds

  • All payments are final and non-refundable once work has commenced or a service period has started, unless otherwise stated in writing or required by law.
  • Domain registration, renewal, or transfer fees are non-refundable as these are handled by third-party registrars.

Disputes

  • If you believe an invoice is incorrect, please contact us immediately. Disputing an invoice does not suspend your obligation to pay on time. Any adjustments, if applicable, will be handled separately.

6. Support & Access

  • AMH Digital acts as your first point of contact for hosting support.
  • For complex issues, we liaise directly with the hosting provider's technical staff on your behalf.
  • Accessing the hosting control panel yourself (if we grant it at your request) voids our warranty and support coverage.

7. Liability

  • We strive for 99.9% uptime but cannot guarantee uninterrupted service due to factors beyond our control (e.g., network outages, software bugs).
  • As hosting infrastructure is operated by a third party, certain issues are subject to their policies and response times.
  • We are not liable for any indirect losses, such as lost profits or business opportunities.
  • You are responsible for your website content and compliance with applicable laws.

8. Zero-Tolerance Policy

  • Threats, harassment, or abusive behavior towards our team will result in immediate termination of services without refund and may be reported to authorities.

9. Governing Law

  • These Terms are governed by the laws of Mauritius in relation to our services, while the hosting infrastructure itself is governed by the laws of the United Kingdom (or the selected region if hosting is arranged in the EU, USA, or another region).
